APPEAL PROCESS

 

THE ACT OF HARASSMENT



A. If a person feels harassed they can choose one of three options.
1. The receiver should respectfully confront the sender to:
a. Provide notice to the sender on how you're feeling
b. Find out the intent of the sender
c. Work out conflict and try to reach an agreement
2. Receiver contacts advisor or other teacher/staff member:
a. Staff member talks with the sender and hears their version of the incident.
b. Staff, with receiver and sender, attempts to mediate and work out conflict
c. Peer mediator may be used.
3. Receiver contacts administrator:
a. Administrator contacts the sender.
b. Administrator, with receiver and sender, attempts to mediate and to work out the conflict.
c. Peer mediator may be used.


B. If harassment is significant or persistent by the sender to the receiver.

  1. The receiver fills out a letter of harassment and meets with the administrator stating the specifics of harassment.
  2. The administrator meets with the sender asking for written or verbal response. (Parents/guardian may be informed)
  3. The administrator, advisor(s), and a peer mediator (as a group) will review information with the sender and the receiver.


C. The following are the possible sanctions, consequences, or responses, pertaining to individual or specific incidents, that may be decided by the group (administrator-staff-mediator). The sender's past record concerning harassment at Shabazz may be used in the groups decisions concerning sanctions.

1. Mediation resulting in compromise solution for resolution of conflict.
2. (a) Verbal warning, (b) written warning, (c) Dropped from the program.
3. Written warning; second incident leads to being dropped from Shabazz.
4. Suspension
5. Dropped from Shabazz
6. Apology (ies)
7. Apology and sanctions
8. Some combination of the above and/or other sanctions that may more fully fit the harassment.

The sender (and the parents of the sender, if it is determined to be of a serious nature) meet with the administrator to receive the group's decision. Failing to abide by the decision leads to being dropped from our program. The decision may be appealed.

If the student accused of harassment physically retaliates the student will be dropped from the program at Shabazz.

THIRD PERSON HARASSMENT



If a person witnesses something that he or she believes is harassing to another person, he or she may initiate harassment proceedings. The third person should notify the sender. Staff must then contact the alleged victim to verify the incident. The person believed to have been harassed does not need to file harassment to agree with the complaint. If the person believed to have been harassed does not agree that it was harassment, the complaint is dropped. This does not include complaints filed by people witnessing a situation that is personally harassing. Someone who did not witness the incident cannot file the harassment.

TIME LIMITS



The student must file harassment within two weeks of the last incident. The student may use other previous incidents as well to substantiate the claim provided these incidents are specific. We feel that a time limit of two weeks is ample time to report an incident of it is truly harassment. This will hopefully deter someone from filing a complaint regarding a past incident.

APPEAL PROCESS



The sender or the receiver writes a statement on why they want to appeal. They have three weeks to appeal after a decision has been made. A new group, consisting of three staff members and a peer mediator, must be present for appeal (administrator will not be present). After appeal meeting, the group can meet with the administrator and recommend dropping the harassment charge, lessen the punishment, or recommend no change from the original decision.
